FELINE BOARD AND CARE CONTRACT

 

1.       SBCAL Properties, Inc., dba The Cat House Hotel (THE CAT HOUSE HOTEL), a feline board and care facility, agrees to board the animal described in the Daily Care Form and to provide other services described in the Daily Care Form at the rates stated therein.

 

CHARGES

2.       ________________________________ (OWNER) agrees to pay for services at the time the animal is picked up by, or delivered to, OWNER or agent after completion of services.  OWNER agrees that, for the purposes of computing boarding charges, any part of a calendar day will be considered as a full day.  By signing this agreement, OWNER specifically authorizes the The Cat House Hotel to charge the OWNER’s credit card for services rendered and submit for payment without OWNER’s signature.

 

STATUS OF ANIMAL

3.       OWNER certifies that all the information stated in the Daily Care Form regarding the animal is correct.  OWNER guarantees that the animal is in good health, that it has NOT been exposed to contagious disease within the past 30 days.  OWNER stipulates that in order to maintain a flea-free environment, the Cat House Hotel staff will check for the presence of fleas and, if evidence of fleas is found, will treat the animal and charge the customer accordingly.

 

ILLNESS OR INJURY

4.       If the animal becomes ill or injured, THE CAT HOUSE HOTEL shall immediately attempt to notify OWNER or, if OWNER cannot be contacted, the alternate party listed in the Daily Care Form.  If OWNER cannot be reached or, fails to instruct THE CAT HOUSE HOTEL regarding measures to be taken, or if an emergency situation exists, THE CAT HOUSE HOTEL is authorized to engage the services of a veterinarian or administer medicine or give other attention that appears advisable.  OWNER shall pay to THE CAT HOUSE HOTEL all costs of these services, within 30 days following the performance thereof.

 

LIMITATION OF LIABILITY

5.       OWNER agrees to indemnify and hold THE CAT HOUSE HOTEL and its directors, officers, shareholders, agents, representatives, insurers, successors and assigns, harmless from all liability for any loss, damage, or injury to persons, animals, or for loss of property arising from or related to the boarding of the animal.  OWNER agress that THE CAT HOUSE HOTEL shall not be liable for loss of or damage to the animal by any cause whatsoever, including but not limited to fire, theft, or escape of the animal.

 

ABANDONED ANIMALS

6.       Civil Code section 1834.5 provides as follows:  Notwithstanding any other provisions of law, whenever any animal is delivered to any veterinarian, dog kennel, pet-grooming parlor, animal hospital, or any other animal care facility pursuant to any written or oral agreement entered into after the effective date of this section, and the owner of such animal does not pick up the animal within 14 calendar days after the day the animal was due to be picked up, that animal shall be deemed to be abandoned.  The person into whose custody the animal was placed for care shall first try for a period of not less than 10 days to find a new owner for the animal, and if unable to place the animal with a new owner, shall thereafter humanely destroy the animal so abandoned.  If an animal so abandoned was left with a veterinarian with a facility which has a veterinarian, and a new owner cannot be found pursuant to this section, such veterinarian shall humanely destroy the animal.  OWNER agrees to pay boarding fees of the animal deemed abandoned pursuant to Civil Code

section 1834.5 until such time as THE CAT HOUSE HOTEL is able to place the animal with a new owner or said animal is humanely destroyed.  Owner agrees to pay the statement for said board and care fees within 15 days of the billing statement.

 

ATTORNEY’S FEES

8.       If any legal action is brought to enforce the provisions of the agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees.  These fees, which may be set by the court in the same action or in a separate action brought for that purpose, are in addition to any other relief to which the prevailing party may be entitled.  The provision applies to the entire agreement.
